{"id":9373,"date":"2019-07-18T11:25:35","date_gmt":"2019-07-18T15:25:35","guid":{"rendered":"https:\/\/blog.brainstation.io\/?p=9373"},"modified":"2019-09-11T13:13:33","modified_gmt":"2019-09-11T17:13:33","slug":"what-is-the-aoda","status":"publish","type":"post","link":"https:\/\/brainstation.io\/blog\/what-is-the-aoda","title":{"rendered":"What is the AODA?"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">We\u2019ve written about why investing in <\/span><a href=\"https:\/\/brainstation.io\/blog\/what-is-web-accessibility-and-why-is-everyone-talking-about-it\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">web accessibility<\/span><\/a><span style=\"font-weight: 400;\"> is important, and organizations working to <\/span><a href=\"https:\/\/brainstation.io\/blog\/5-ways-to-make-your-content-more-accessible\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">make their content more accessible<\/span><\/a><span style=\"font-weight: 400;\"> typically follow guidelines enacted by a government body.\u00a0 In the US, most organizations adhere to \u201cSection 508\u201d (also known as \u201c<\/span><a href=\"https:\/\/brainstation.io\/blog\/what-is-section-508-compliance\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">508 compliance<\/span><\/a><span style=\"font-weight: 400;\">\u201d). In Canada, accessibility guidelines are mandated by provincial governments. In Ontario, Canada\u2019s most populous province, organizations must comply with the <\/span><i><span style=\"font-weight: 400;\">Accessibility for Ontarians with Disabilities Act <\/span><\/i><span style=\"font-weight: 400;\">(AODA).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s take a closer look at what the AODA means and what it covers.\u00a0<\/span><\/p>\n<h2><b>What is the AODA?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The AODA is an Ontario law mandating that organizations follow accessibility standards for people with disabilities. All levels of government, private sectors, and nonprofits are required to comply with the act\u2019s requirements, with deadlines specific to each organization\u2019s type and size.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Ontario government passed the AODA in 2005, but it was actually something of an expansion of the <\/span><i><span style=\"font-weight: 400;\">Ontarians with Disabilities Act<\/span><\/i><span style=\"font-weight: 400;\">, which was passed in 2001. With the AODA, Ontario became the first province in Canada to enact accessibility legislation covering public, private, and nonprofit sectors.\u00a0<\/span><\/p>\n<h2><b>What are Disabilities Under the AODA?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The AODA uses the same definition of \u201cdisability\u201d as the <\/span><a href=\"http:\/\/www.ohrc.on.ca\/en\/policy-and-guidelines-disability-and-duty-accommodate\/2-what-disability\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ontario Human Rights Code<\/span><\/a><span style=\"font-weight: 400;\">, which states that the term covers: <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">any degree of physical disability, infirmity, malformation or disfigurement that is caused by bodily injury, birth defect or illness and, without limiting the generality of the foregoing, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical coordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical reliance on a guide dog or other animal or on a wheelchair or other remedial appliance or device,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a condition of mental impairment or a developmental disability,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a learning disability, or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">a mental disorder, or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">an injury or disability for which benefits were claimed or received under the insurance plan established under the <\/span><i><span style=\"font-weight: 400;\">Workplace Safety and Insurance Act<\/span><\/i><span style=\"font-weight: 400;\">, 1997.<\/span><\/li>\n<\/ol>\n<h2><b>What is the Purpose of the AODA?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The AODA\u2019s goal is to make Ontario accessible to all by 2025. To accomplish that, the act establishes standards for businesses and organizations to identify and remove accessibility barriers in five areas:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Customer service<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Transportation<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Information and communication<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Built environment (or the design of public spaces)<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Employment<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">These AODA standards are part of the <\/span><i><span style=\"font-weight: 400;\">Integrated Accessibility Standards Regulation<\/span><\/i><span style=\"font-weight: 400;\"> (IASR). The IASR provides requirements for each standard, and mandates that organizations must:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Train staff and volunteers<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Develop an accessibility policy<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Create an accessibility plan and update it every five years<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Include accessibility in procurement and when designing or purchasing self-service kiosks<\/span><\/li>\n<\/ul>\n<h2><b>The AODA and Accessibility Policies\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">As stated above, the AODA requires all public sector organizations to develop an accessibility policy. Private and non-profit organizations, on the other hand, only have to comply with this requirement if they have more than 50 employees.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">An accessibility policy puts organizations\u2019 commitment in writing, helping them set goals, identify barriers, and determine how those barriers can be removed. It should work hand-in-hand with an accessibility plan that outlines the steps an organization has to take to be accessible to all, and when it will complete those steps.<\/span><\/p>\n<h2><b>Penalties for Not Complying to the AODA\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If an organization does not comply with the AODA, they may be fined up to $100,000 per day, with directors and officers also fined up to $50,000 per day. These, it should be noted, are maximum penalties.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As of 2017, organizations with more than 20 employees are required to submit an online compliance report, which confirms their adherence to the AODA.\u00a0<\/span><\/p>\n<h2><b>Compliance is Good for the Bottom Line\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Royal Bank of Canada estimates that people with people with disabilities have an annual spending power of $25 billion. That demographic also represents one of the largest pools of untapped employment talent. In short, improving your organization\u2019s accessibility \u2013 both from a digital and operational point of view \u2013 can be a net benefit, expanding your potential audience and workforce.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Interested in web accessibility?
